Processor
AssetCare B.V., AssetCare Fund Services B.V., AssetCare Bewaarder Services B.V. and AssetCare Consultancy B.V. form a group of companies, all of which are wholly owned by AssetCare Holding B.V. This privacy statement is issued on behalf of all such legal entities. Where this statement refers to “AssetCare”, “we”, “us”, or “our”, this refers to the relevant legal entity within AssetCare that is responsible for the processing of your personal data.

We may disclose or transfer personal data collected by us between the various legal entities within AssetCare, insofar as this is reasonably necessary for the purposes of our services or for compliance or legal purposes.

Purposes of data processing
We do not collect or use information for purposes other than those described in this privacy statement, unless we have obtained your prior (explicit) consent to do so.

The primary purpose of this website is to generate interest among potential clients. Potential clients may, at their own initiative, schedule a meeting with AssetCare via this website, in which case a name, email address, and telephone number are collected. Other than this functionality, no personal data is collected through this website for any purpose. If, however, your data is collected by us in the course of another business process, we will process your personal data in order to contact you regarding our services and to conduct business with you.

AssetCare may process your personal data for the performance of an agreement, to take steps at your request prior to entering into an agreement, where you have given your (explicit) consent to such processing, on the basis of a legal obligation, or where we have a legitimate interest.

Which data is processed?
Personal data includes any information relating to an identified or identifiable natural person. We process, among others, the following categories of personal data:

In general, personal data is provided directly by you. However, AssetCare may also obtain your personal data from sources other than directly from you. This may include information obtained through compliance tooling, the local Chamber of Commerce, or in connection with the performance of other (legal) checks aimed at preventing corruption, identity theft, financial fraud, money laundering, and/or terrorist financing.

Our clients are managers of investment funds, pension funds, and insurance companies. Where you are, or become, a participant in one of these clients, we process your personal data under the responsibility of our client (to the extent agreed with the client). In such cases, the fund manager, pension fund, or insurance company acts as the data controller, and we act as the data processor.

Because you are, or wish to become, an employee of AssetCare
In order to communicate with you as our (prospective) employee and to comply with our legal obligations as an employer, we process certain personal data necessary for the employer–employee relationship.

Because you are, or will become, a supplier of AssetCare
In order to conduct business with you as our supplier, we process both personal data and business-related information.

Because AssetCare has a legal obligation to collect and share your data
Your personal data will only be shared where we are legally obliged to do so. This may include disclosure to, for example, the Tax Authorities, local governmental bodies, law enforcement authorities such as the Police or the Public Prosecution Service, or the Data Protection Authority.

Sharing personal data with third parties
We share personal data with third parties where you have provided your consent or have instructed us to do so. Such third parties may include, for example, IT service providers, security service providers, or HR service providers.

Where we engage external parties that process personal data on our behalf, we enter into data processing agreements that set out restrictions on the use of personal data and obligations relating to the protection and security of such data.

Protection of your data
We take all necessary measures to ensure that data is stored and transmitted securely. Your data is stored on secure servers operated by AssetCare or by third parties. These servers are generally located within Europe, where all countries are legally required to provide an adequate and appropriate level of data protection.
